Your Excellency,

We are writing on behalf of the Coordinating Committee of Press Freedom Organizations, which represents global press freedom organizations, to express our serious concern at the government’s decision not to renew the television broadcasting licence of Radio Caracas Television (RCTV).

RCTV, the country’s oldest private channel, went off the air when the government refused to renew its television broadcasting licence which expired on 27 May. Of the three commercial stations accessible in all parts of Venezuela, RCTV was the only station that was strongly critical of the government.

Your government had repeatedly threatened not to renew RCTV’s licence since accusing it of supporting an April 2002 coup attempt – accusations which have led to no convictions – and in March 2007 published details of its case against RCTV. The charges included “inciting rebellion”, showing “lack of respect for authorities and institutions”, breaking the laws protecting minors, engaging in monopolistic practices and failing to pay taxes. However, the government failed to cite a single final judicial or administrative ruling establishing that the channel had committed any of these alleged offences.

The authorities have clearly failed to observe internationally recognized norms of justice in arriving at their decision: no procedure was established to enable RCTV to present evidence and arguments in its favour; the criteria on which the decision was based were not established clearly beforehand; and there was no process allowing RCTV the continuation of its concession.

We respectfully remind you that refusing to relicence RCTV for political reasons is a clear breach of the right to freedom of expression, which is guaranteed by numerous international conventions, including the Universal Declaration of Human Rights. Article 19 of the Declaration states: “Everyone has the right to freedom of opinion and expression; this right includes the freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media, regardless of frontiers.”

We respectfully call on you to do everything possible to reverse this decision and to give RCTV the due process of law and equal opportunities to apply for concession renewal. We ask that you take all necessary steps to halt the intimidation of the independent press in Venezuela and that in future your country fully respects international standards of freedom of expression.

Le escribimos en nombre del Comité Coordinador de Organizaciones de Libertad de Prensa, el cual representa a organizaciones de libertad de prensa de todo el mundo, para expresar nuestra seria preocupación por la decisión de su gobierno de no renovar la licencia de emisión a Radio Caracas Televisión (RCTV).

RCTV, el canal de televisión más antiguo de Venezuela, dejó de emitir al negarse su gobierno a renovar la licencia de emisión, la cual expiró el 27 de mayo. De las tres estaciones comerciales accesibles en toda Venezuela, RCTV fue la única que criticó abiertamente a su gobierno.

Su gobierno ha amenazado repetidas veces con no renovar la licencia de RCTV desde que el canal fue acusado de apoyar el intento de golpe de estado de abril de 2002 —acusación que no ha generado ningún tipo de acción judicial— y desde que en marzo de 2007 dicho gobierno publicó detalles de su caso contra esta emisora. Las acusaciones incluyeron “incitar a la rebelión”, mostrar “falta de respeto por las autoridades e instituciones”, violar las leyes que protegen a los menores, involucrarse en actos monopolísticos y evadir impuestos. Sin embargo, su gobierno no ha dictado ningún fallo judicial ni administrativo que establezca que el canal haya cometido ninguna de estas violaciones.

Las autoridades claramente han fracasado en su intento de observar normas de justicia reconocidas internacionalmente en este sentido: No se ha establecido procedimiento alguno para permitir a RCTV que presente pruebas o argumentos en su favor; los criterios en los que se han basado esta decisión no fueron establecidos claramente de antemano; y no existió proceso alguno para permitir que RCTV continúe operando su licencia.

Respetuosamente nos permitimos recordarle que rechazar la renovación de la licencia de RCTV debido a razones políticas es una clara violación del derecho a la libre expresión, el cual está garantizado en numerosas convenciones internacionales, incluyendo la Declaración Universal de los Derechos Humanos. Su Artículo 19 reza: Todo individuo tiene derecho a la libertad de opinión y expresión; este derecho incluye el de no ser molestado a causa de sus opiniones, el de investigar y recibir informaciones y opiniones, y el de difundirlas, sin limitación de fronteras, por cualquier medio de expresión.

Respetuosamente lo instamos a hacer todo lo posible para revertir esta decisión y conceder a RCTV el debido proceso legal y la igualdad de oportunidades para solicitar la concesión de la renovación de su licencia. Lo urgimos a que cese todos los actos de intimidación contra la prensa independiente de Venezuela y que en el futuro su país respete los estándares internacionales de libertad de expresión.
