Your Excellency:
On behalf of the World Press Freedom Committee (www.wpfc.org) — an organization that represents 45 press freedom groups from six continents — I wish to express my great concern about the congressional approval of the Bill for the creation of the Peruvian International Cooperation Agency, which contains violations to freedom of expression and freedom of the press.
The Bill number 27692, which has already arrived to your desk for your signature, applies onerous controls over the financial aid that non-governmental organizations (NGO) receive from foreign sources, and also restricts these entities’ freedom of association and freedom to establish financial relationships.
The bill partly justifies this flagrant meddling in the free and legal functioning of NGOs “in order for them to function within the national development policy and according to the public interest,” reads the bill.
One of these organizations, Instituto Prensa y Sociedad (IPYS), which has been morally and financially supported by WPFC in several occasions, very rightly expressed its “rejection of this new bill because it posses a grave threat to freedom of expression and freedom of the press by giving the State the power to approve the content of all programs subject to international cooperation.”
Our cooperation with IPYS has been fruitful and has made a substantial contribution to press freedom in Peru. Specifically, a few years ago, we funded the legal effort that eventually earned the freedom of four journalists who unjustly had been given long prison sentences during the regime of Alberto Fujimori. On another occasion, our letter of support, which was requested by IPYS, was instrumental for the Peruvian justice to exonerate a journalist who had been the victim of a campaign of harassment and intimidation and unjustly accused of manufactured crimes.
Our successes during our long cooperation with IPYS were possible thanks to an independent relationship devoid of any intervention by the Peruvian State. Bill number 27692 threatens that very relationship.
What would the Peruvian State think if its vital international aid were controlled by the country’s NGOs? Peru’s good relationship with international financial institutions, such as the World Bank and the Inter-American Development Bank, constitutes a crucial component of the good functioning and development of the country. Likewise, Peruvian NGOs require independence in order to maintain a good relationship with groups such as ours, without which their exemplary work would be profoundly impeded.
Therefore, your Excellency, I urge you to reject signing Bill number 27692 and to use your influence on the Congress so that legislative attempts like this one that restrict freedom of expression and freedom of the press do not repeat themselves.

En nombre del Comité Mundial de Libertad de Prensa (www.wpfc.org) — una organización que representa a 45 grupos de libertad de prensa de todo el mundo — deseo expresar mi gran preocupación para la aprobación por parte del Congreso del Proyecto de Ley de creación de la Agencia Peruana de Cooperación Internacional (APCI), la cual contiene violaciones contra la libertad de expresión y prensa.
El proyecto de ley Nº 27692, el cual ya le ha sido entregado a Usted para su firma, aplica onerosos controles sobre el apoyo económico que las organizaciones no gubernamentales (ONG) reciben del exterior, además de restringir la libertad de asociación y contratación de estas entidades.
La iniciativa en parte justifica esta flagrante ingerencia en la libre y legal actividad de las ONG “a fin que se conduzcan dentro de la política nacional de desarrollo y el interés público”, dice el texto de la iniciativa.
Una de estas organizaciones, el Instituto Prensa y Sociedad (IPYS), al cual el WPFC ha apoyado moral y financieramente en varias ocasiones, con toda la razón expresó su “rechazo ante una ley que significa una grave amenaza a la libertad de expresión y la libertad de prensa, en tanto que le da al Estado la facultad de aprobar los contenidos de los programas sujetos a cooperación internacional”.
Nuestra cooperación con IPYS ha sido fructífera y ha contribuido a la sustancial mejora de la liberta de prensa en el Perú. Concretamente hace unos años financiamos la ayuda legal que eventualmente logró la puesta en libertad de cuatro periodistas que injustamente habían sido condenados a largas penas de cárcel durante el régimen de Alberto Fujimori. En otra ocasión, nuestra carta de apoyo, solicitada por IPYS, a una periodista injustamente acosada y desacreditada en Arequipa fue clave para que la justicia peruana la absolviera de las acusaciones lanzadas contra ella.
Los éxitos logrados durante nuestra larga cooperación con IPYS se realizaron gracias a una relación independiente apartada por completo de cualquier ingerencia del Estado peruano. El proyecto de ley Nº 27692 amenaza la esencia misma de esta relación.
¿Qué le parecería al Estado peruano si la vital ayuda que recibe del exterior fuera fiscalizada por las ONG del país? La buena relación entre Perú y las instituciones internacionales de financiación como el Banco Mundial o el Banco Interamericano de Desarrollo es un componente crucial para el buen funcionamiento y desarrollo del país. De similar manera, las ONG peruanas requieren de independencia para mantener una buena relación con grupos como el nuestro, sin los cuales su ejemplar labor quedaría profundamente impedida.
Por lo tanto, Excelencia, lo insto a que rechace firmar el proyecto de ley Nº 27692 y a que utilice su influencia en el Congreso para que intentos como ésta de limitar la libertad de expresión y prensa en Perú no vuelvan a legislarse.
